✦ YCH & COMMISSIONS ✦

✦ GENERAL ➤1.1 I am an independent freelance artist. By placing an order, the Client acknowledges that all artwork is created manually and individually.1.2 I reserve the right to update these Terms of Service at any time. However, the version of these Terms in effect at the time payment is received shall govern that specific commission. Any later revisions shall apply only to future commissions.1.3 Artistic style may naturally evolve over time as I continue to improve and develop as an artist.1.4 I guarantee that all artwork delivered will be original work created by me to the best of my abilities.1.5 By commissioning me, you confirm that you have the legal right to use any character, design, or intellectual property submitted as reference material.1.6 All communications must remain respectful, professional, and commission-related.1.7 I reserve the right to refuse any project for any reason at my discretion.1.8 By commissioning me, you must be at least 18 years old, or have permission from parents to make a purchase (SFW ARTWORKS ONLY)1.9 I do not permit the use of any of my art (including commissioned art or fanart) for generation using AI (Artificial intelligence/neural network) or other AI services to create ANY new content (including “improving” quality, creating 3D models, animations, etc.). I also do not permit the use of any of my art for “training” or creating/improving AI models or generations.1.10 Your character should be of a suitable age based on the description of the art.1.11 The private art must be specified in advance in the description of the commission. (NDA)If you require commercial use of the image, please discuss this with me.1.12 You can create merchandise with my artwork for personal (non-commercial) use and you also may resize or crop the artwork to create some graphics to be used in non-commercial digital format, but you cannot make changes to the artwork itself and remove the watermark from the public web-version. You may upload and share the artwork on other platforms and galleries with attribution of our authorship.1.13 You may not profit from the commissioned artwork or its use (in digital or physical format).1.14 I may ask for an extra payment if your character is complex or wears complicated accessories/clothing.1.15 I reserve the right to refuse any commission task for any reason, which I am entitled not to disclose.

✦ REFERENCE IMAGES ✦

2.1 The Client is responsible for providing complete, accurate, and up-to-date reference material before work begins.2.2 The quality and accuracy of the final artwork depends heavily on the quality and accuracy of the references provided.2.3The Artist is not responsible for mistakes, omissions, inaccuracies, or inconsistencies resulting from incomplete, outdated, contradictory, misleading, or missing reference material.2.4 Visual references are required for all commissions.2.5 Text-only descriptions are generally not accepted as the sole source of information.2.6 If no visual reference sheet exists, the Client must provide supporting visual material such as:✦ Moodboards
✦ Example images
✦ Stock Images
✦ Color references
✦ Design references
✦ Character inspiration images
✦ Other visual material that accurately represents the intended design2.7 The Artist reserves the right to refuse commissions that lack sufficient visual references.2.8 If multiple references are provided, the Artist will generally work from the most recent reference supplied by the Client unless otherwise specified.2.9 It is the Client's responsibility to clearly indicate which reference should be considered the primary reference.2.10 For 3D model references, Clients are strongly encouraged to provide RGB, HEX, or equivalent color values for all major colors.2.11 Lighting, shaders, rendering effects, reflections, environmental lighting, post-processing effects, and software-specific rendering settings may alter the appearance of colors within 3D applications.2.12 The Artist is not responsible for color discrepancies resulting from missing RGB, HEX, or equivalent color information.2.13 The Client is responsible for reviewing all submitted references before payment and ensuring that they accurately represent the desired character at the time the order is placed.2.14 Any modification, redesign, update, replacement, correction, or alteration to the character design, color palette, markings, accessories, clothing, anatomy, species, or any other commission-related information submitted after payment may result in additional fees and may restart the turnaround time at the Artist's discretion.

✦ TIMELINE & PROCESS ✦

3.1 Turnaround time is not guaranteed and may vary depending on commission complexity, workload, health, personal circumstances, or other unforeseen events. The average turnaround time is between 7 days and 5 months (rare). If you require a specific deadline, a +50% Fast Pass fee applies and your commission will receive priority.3.2 Delays caused by illness, emergencies, power outages, internet failures, natural disasters or other circumstances beyond my control shall not constitute breach of contract.3.3 Any modification to references or commission details after payment may restart the turnaround time3.4 Delays caused by real-life circumstances may occur and will be communicated through the Artist's Telegram channel whenever possible.3.5 Most work is YCH-based. WIPs are not included by default. WIP Add-On is available.3.6 Please allow at least 7 days before requesting updates.3.7 After payment and start working on the artwork, I’ll send a sketch(es) for your critiques and approval. At your request I can also provide you with more WIPs of process. (Only custom commissions)3.8 If you wish to make corrections — describe what to change in 1-2 messages. If you are asking make the corrections more than 3 times I reserve the right to request an extra payment. The use of a redline to make your corrections clearer is also welcome.3.9 My own mistakes will be corrected at any stage for free.Post-delivery corrections may require up to 7 additional days.3.10 Client-caused corrections, forgotten information, or design changes may incur additional fees. Post-delivery corrections may require up to 7 additional days.3.11 Finished artwork will be delivered by email in high-resolution PNG format, you get all the files in high resolution.3.12 I don't send .sai/.psd files of my artworks.3.13 If the Client becomes unresponsive for more than 60 consecutive days after I request required information or approval, I reserve the right to place the commission on hold indefinitely until communication resumes.3.14 Delays caused by illness, emergencies, family matters, technical issues, internet outages, power failures, natural disasters, or any other circumstances beyond my reasonable control shall not constitute a breach of these Terms.

✦ PAYMENT & REFUND ✦

4.1 I only work with 100% prepayment.4.2 Payment is made only via:

✦ Direct bank transfer (via secure payment bank links)4.3 Payment must be made within 24 hours after sending my invoice.4.4 I do not make refunds.4.5 Extra payment for complex details and other things.
These things cause extra payment:✦ complex characters design;
✦ complex outfit;
✦ complex details;
✦ complex weapons;
✦ complex ideas;
✦ other complex things making drawing process harder and longer.4.6 Any fraudulent chargeback or payment dispute made after work has begun or after the artwork has been delivered constitutes a breach of these Terms. I reserve the right to dispute any chargeback using invoices, conversations, sketches, WIPs, and completed artwork as evidence.

✦ COPYRIGHT, OWNERSHIP & LICENSES ✦

✦ARTIST RIGHTS ➤✦I reserve the right to share commissions and related WIPs and progress on any of my platforms, for any purpose, including those for promotions, my portfolio, and other commercial uses.✦ The Artist retains full copyright ownership unless otherwise specified through purchased rights or NDA agreements.✦ I have also rights to recycle any rejected and unused WIPs and sketches for any purpose including personal use, resale as YCH, and use in creation of other commissions.✦ CLIENT RIGHTS ➤✦ Personal use only. You may repost or share the watermarked version on your personal platforms as long as you credit me the artist.✦ You can print the artwork, make it a sticker the piece that you've commissioned from me but never reproduce for profit.✦ You are NOT allowed to use my artwork for commercial purposes.✦ COMMERCIAL RIGHTS ➤✦ Commercial rights are not included unless purchased separately.✦This includes streaming,
VTuber/PNGTuber assets, branding, monetized content, merchandise, and advertising.✦Unless specified in the commission information or otherwise discussed and agreed upon, commercial licenses and reselling rights are not included.✦Commercial means usage on streams, broadcast content, or any monetized work (i.e. including but not exclusive to: merchandise, monetized videos, music releases); and reselling rights means selling the Work to another party or another platform or on any platform.
